What Does Product Liability Mean?

Usually, product liability claims are related to machines that cause personal injury or death. The Ford Pinto, by way of example only, was a death trap because the gas tank was vulnerable in rear end collisions. A product such as a machine with a guard that has been removed or products that otherwise do not meet industry standards could be qualified as defective for which a manufacturer is strictly liable.

Product liability deals with dangerous or defective products that result in injury. A product can be dangerous or considered defective by design, due to a manufacturing flaw, or because of inaccurate marketing. Responsibility for a defective product can start with the manufacturer and end with the retailer including all intermediary suppliers. A product can also be considered defective if it lacks instructions or appropriate warnings or dangers for normal use or misuse. 

Takata Airbags are a recent and well publicised example of a defective product that has caused grave injuries and death.
